EASA has issued the Safety Information Bulletin (SIB) with the recommendations to the airlines regarding flight operations in the part of the international airspace over the High Seas, where the responsibility for ATS is delegated to Ukraine
In the SIB No.:2015-16R2 dated 17.02.2016 European Aviation Safety Agency (EASA) recommends the airspace users (airlines) to consider the use of ATS routes L851 and M856 when planning flights within the western part of the international airspace over the High Seas, where the responsibility for ATS is delegated to Ukraine by regional air navigation agreements as approved by ICAO Council Decision of 17 February 1997.

EASA SIB confirms the legitimacy of Ukraine for providing ATS within Simferopol Flight Information Region (FIR) and for publishing aeronautical information concerning Simferopol FIR.

At the same time the SIB states that the Russian Federation is not internationally recognised to provide services within Simferopol FIR and therefore any Aeronautical Information Publications of the Russian Federation with regard to Simferopol FIR are not internationally recognised.

Obviously, such publications of the respectful international aviation organisation proves the unconditional recognition of Ukraine’s efforts and measures aimed at successive normalization of air traffic flows management over the High Seas, where the responsibility for ATS is delegated to Ukraine.

The above measures have foreseen the implementation of special procedures for flight planning and operations inclusive of operations over the High Seas that were stipulated by «Safety Case regarding provision of Air Navigation Services within Ukrainian airspace and airspace over the High Seas where the responsibility for ATS is delegated to Ukraine by international agreements» (hereafter – Safety Case). Safety Case was developed by the representatives of UkSATSE in close collaboration with European Organisation for the Safety of Air Navigation (EUROCONTROL), International Civil Aviation Organization (ICAO) and approved by the State Aviation Administration of Ukraine.

The main conclusion of Safety Case is that ATS in the airspace under the responsibility of Ukraine are provided by the authorized units of Ukraine with ensuring safety of flights. It should be notified that the declared types of air navigation services in the western part of Simferopol FIR are provided by Odessa ACC.

The above SIB is based on Ukraine’s report on the performed post implementation monitoring for the period of 60 days (27 August – 25 October 2015) starting from the beginning of carrying out the first phase of the implementation of special procedures.

This phase determines the partial availability of ATS routes in the western part of the international airspace over the High Seas, where the responsibility for ATS is delegated to Ukraine.

The Post implementation monitoring proves the effectiveness of the measures taken by Ukraine based on Safety Case. It should be clearly stated that Ukrainian airspace over temporary occupied territory of the Autonomous Republic of Crimea remains closed for flight operations of all aircraft without any exception.

It should be notified that about 15 airlines have been already using these 2 ATS routes while the potential number of airspace users considering the use of the above routes after issuing EASA SIB may increase to 40 airlines.

We believe that usage of the recommended by EASA ATS routes will allow the airspace users to reduce their costs and contribute to making the ATS routes in the FIRs of the adjacent states less crowded.
