Charges for Air Navigation Services
Collection of air navigation charges is regulated by the legislation of Ukraine and international legal acts.
According to the Air Code of Ukraine (Article 36 items 1 and 2) air navigation services for flights (en-route, terminal) are performed by air navigation service providers on a paid basis. The amount of unit rates for air navigation services to aircraft (en-route, terminal) is equal for all the users of the Ukrainian airspace and is established according to the Ukrainian legislation, International Civil Aviation Organization standards and recommended practice and EUROCONTROL documents.

Payment for ANS by residents of Ukraine
The conclusion of the Agreement for the provision of ANS between UkSATSE and airspace user is a condition of guaranteed provision of the ANS.
Procedure of conclusion of Air Navigation Service Agreement
The Agreement for the provision of Air Navigation Services shall be concluded between UkSATSE and users – residents of Ukraine, as well as private persons – residents of Ukraine which are aircraft owners or lessees.
The text of the Agreement shall expressly state the conditions of provision/receipt of Air Navigation Services and the payment procedure for the Air Navigation Services provided.
The Agreement shall be concluded for the period not longer than one year. It shall remain in effect from January 01 till December 31 of the same year.
Conclusion of the Agreement is one of the obligatory conditions for receiving Air Operator Certificate issued by the State Aviation Administration of Ukraine.
Provided that the Agreement was concluded for a current year and a user or private person has no outstanding debts for the ANS provided, the Agreement forms for the next year will be sent to the users'/ private persons' addresses indicated in the previous Agreement.
When a user is going to conclude the Agreement for the first time, the authorized representative of the user shall apply to UkSATSE Air Navigation Charges Department (see contact information below).

Measures to debtors which have not settled amount due
(item 4, Article 36 of the Air Code of Ukraine)
In accordance with Air Code of Ukraine in case the airline-debtor has not paid the amount due according to the issued bill (and no claim was submitted) – enforced recovery measures may be taken including aircraft detention and suspension of the provision of ANS after 3 days term from the date of receipt by a debtor of a written notification, as well as absence of the reasonable causes for prolongation of the debt settlement terms. Responsibility for unsettlement of the debt is borne by both operator and owner of aircraft.
UkSATSE performs procurement of goods, works and services at its own expenses. Procurement procedures are defined pursuant to the Law of Ukraine “On peculiarities of procurement process in specific areas of business activities” No.4851-VI dated 24.05.2012 and the Law of Ukraine “On public procurement” No.1197-VII dated 10.04.2014.

Procurement according to EBRD Procurement Policies and Rules
UkSATSE is implementing Modernization of the Air Navigation System of Ukraine Project. The financing of the Project is performed by the loan funds provided by European Bank for Reconstruction and Development (EBRD) and European Investment Bank (EIB).
The Project foresees the procurement of the following equipment with related services:
1. Extension of the UkSATSE Backbone Telecommunication Network (BTN)
2. Receiving-transmitting radio centres with VoIP function
3. Gateways to implement VoIP in the existing VCS
4. Distance Measuring Equipment (DME)
5. PSR/SSR Mode S (EHS)
According to the para 2 clause 6 of the Law of Ukraine “About public procurement” the procurement of the goods, works and services within this Project is performed in accordance with EBRD Procurement Policies and Rules.
