Charges for Air Navigation Services
Collection of air navigation charges is regulated by the legislation of Ukraine and international legal acts.
According to the Air Code of Ukraine (Article 36 items 1 and 2) air navigation services for aircraft flights (en-route, terminal) are performed by air navigation service providers on a paid basis. The amount of unit rates for air navigation services to aircraft (en-route, terminal) is equal for all the users of the Ukrainian airspace and is established according to the Ukrainian legislation, International Civil Aviation Organization standards and recommended practice and EUROCONTROL documents.

Procedure on billing and collecting charges for ANS
Services to airlines shall be provided upon submission of flight request (RPL, FPL).
Billing and collection of charges for en-route air navigation services provided for flights
operated from 01 November is carried out by the Eurocontrol Central Route Charges Office in accordance with Ukrainian legislation, ICAO documents and EUROCONTROL procedures.
Payment shall be made according to the details indicated in Eurocontrol bills.
Billing and collection of charges for terminal air navigation services
is performed by Ukrainian State Air Traffic Services Enterprise (UkSATSE) under the Ukrainian legislation, in accordance with ICAO documents and EUROCONTROL procedures.
Payment of invoices for flights carried out
before November 01, 2021 shall be made according

Payments for flights billed by UkSATSE for provision

Procedure on Air Navigation Services Agreement conclusion
The Agreement for the provision of Air Navigation Services shall be concluded between UkSATSE and users – residents of Ukraine, as well as private persons – residents of Ukraine which are aircraft owners or lessees.
The Agreement shall be concluded for the period not longer than one year. It shall remain in effect from January 01 till December 31 of the same year.
Whether the user concludes the Agreement for the first time, the authorized representative of the user shall apply to UkSATSE Air Navigation Charges Department (tel. +380 44 351 57 07, е-mail:

Sanctions against debtors that failed to pay the debt for the rended air navigation services
In accordance with Air Code of Ukraine (item 4 of art. 36 of the Air Code of Ukraine) in case a debtor failed to pay the amount due of a bill not appealed against within the prescribed time limit – enforced recovery measures may be taken including detention of the aircraft and termination of provision services to the debtor's aircraft after the expiry of a three-day period from the date on which the debtor received the relevant written notification, as well as absence of the reasonable causes for prolongation of the debt settlement terms. Responsibility for unsettlement of the debt is borne by both operator and owner of aircraft.
Procurements
UkSATSE performs procurement of goods, works and services at its own expenses. Procurement procedures are defined pursuant to the Law of Ukraine “On peculiarities of procurement process in specific areas of business activities” No.4851-VI dated 24.05.2012 and the Law of Ukraine “On public procurement” No.1197-VII dated 10.04.2014.

Procurement according to EBRD Procurement Policies and Rules
UkSATSE is implementing Modernization of the Air Navigation System of Ukraine Project. The financing of the Project is performed by the loan funds provided by European Bank for Reconstruction and Development (EBRD) and European Investment Bank (EIB).
The Project foresees the procurement of the following equipment with related services:
1. Extension of the UkSATSE Backbone Telecommunication Network (BTN)
2. Receiving-transmitting radio centres with VoIP function
3. Gateways to implement VoIP in the existing VCS
4. Distance Measuring Equipment (DME)
5. PSR/SSR Mode S (EHS)
According to the para 2 clause 6 of the Law of Ukraine “About public procurement” the procurement of the goods, works and services within this Project is performed in accordance with EBRD Procurement Policies and Rules.
