Today the Supreme Court of Ukraine has finally put an end to UIA's attempt to recover UAH 876 million from UkSATSE for alleged overpayments for services rendered in 2016-2018. The airline's cassation appeal has been dismissed.

Let us recall how the situation developed. At the end of 2018, UIA filed a case against UkSATSE to recover UAH 876 million. Let us recall how the situation developed. The rationale was that UkSATSE cannot make profit from its legitimate activities, and it was argued that UkSATSE has to agree with UIA on charges for air navigation services, while the charges are regulated by the Ministry of Infrastructure order. In addition, UIA thought it had discovered that UkSATSE had misused the funds and therefore it wanted to deduct them from the amount it had already paid for the provider's services rendered.

It is important to note that this airline used to conclude contracts for aeronautical services with UkSATSE for several years without any objections, accepting these services, signing certificates and making payments.
UkSATSE won the case in March 2020 at the Commercial Court of Kyiv Region. The Northern Commercial Court of Appeal in January 2021 upheld the first-instance court's decision, despite UIA's last-minute attempts to change the substance of the dispute and provide a strange conclusion of a Zaporizhzhia expert that was not at all related to the subject matter of their claim.

The successive victories in this case were made possible by the coordinated work of specialists from various units of UkSATSE, as well as the determined stance and activity of the enterprise's trade unions on defending its interests.

UIA has spent UAH 2,700,000 on legal fees alone in this case.
